Lagos' New Towns Development Authority Breaks Law While Collecting Personal Data Online – FIJ NG

The website of Lagos State Government’s New Towns Development Authority (NTDA) has no privacy policy, a review by FIJ has found.
NTDA, a Lagos government parastatal established in 1981, is responsible for implementing the planned growth of the state. According to information on its website, the agency establishes new towns, develops government schemes, provides infrastructure in government estates, promotes large-scale physical development, selects sites for government ministries and private developers and monitors unauthorised developments within government estates.
When FIJ visited the site — https://ntda.lg.gov.ng/ — on Monday, it found that the site had no accessible privacy policy statement, despite collecting personal data, such as names and email addresses, via its contact form.

The absence of a publicly available privacy policy is worth spotlighting because the Nigeria Data Protection Act (NDPA) 2023 requires data controllers to provide data subjects with information about the processing of their personal data in a concise, transparent and easily accessible manner when personal data is collected.
A privacy policy statement on a website typically explains to visitors what kind of personal data is collected, the purpose for collecting such information, how it is stored and protected, who it is shared with and how users can exercise their rights over their data.
Beyond violating the NDPA, this website also runs afoul of the Standards and Guidelines for Government Websites set by the National Information Technology Development Agency (NITDA).
NITDA mandates government institutions to have privacy statements clearly displayed on their websites, and the agency says any violation of its guidelines is considered a breach of the NITDA Act 2007 and shall be punished in accordance with the provisions of the Act.

On privacy policy, Section 7.2 states:
“Government websites shall include a standard privacy policy statement that stipulates: a. how information collected is used b. circumstances where information can be disclosed to a third party c. if the information is accessible by the public.”
Section 10.4 (ii) also states that public institutions must “incorporate prominently displayed Privacy Statement clearly stating the purpose for which information is being collected where the Government Institution seeks to or collects personal information from visitors through their website”.
For some time, FIJ has been reporting how government institutions at both the state and federal levels, including ministries, departments and agencies, continue to ignore regulatory requirements that their websites display accessible privacy policies.
The list of data laws violators in Nigeria continues to expand.
